SupWand 服务条款

运营主体：深圳市赛杰电子有限公司。使用 SupWand 的 App、账号、线上房间或应援棒控制功能，即表示你同意本条款及《SupWand 隐私政策》。

1. 适用范围和使用资格

SupWand 用于发现、连接和控制兼容应援棒，并提供账号、设备管理、线上房间和灯光同步功能。你应具备与自身行为相适应的民事行为能力；未成年人应在监护人阅读并同意本条款后使用账号和线上功能。

2. 账号和安全

  • 当前账号通过中国大陆 +86 手机号和短信验证码创建或登录。
  • 你应使用本人有权使用的手机号，并妥善保管手机、验证码和已登录设备。
  • 不得买卖、出租、冒用账号，不得规避登录、权限、频率限制或其他安全机制。
  • 如发现未经授权的账号或设备使用，请尽快联系支持中心。

3. 兼容硬件、权限和网络

蓝牙控制需要兼容应援棒、蓝牙权限和正常工作的设备固件；声音律动需要用户主动授予麦克风权限；线上房间需要互联网连接和正式服务器。距离、无线干扰、电量、固件、系统权限、网络或维护可能影响部分功能。

请遵守场馆规定、当地法律和现场安全要求。闪烁灯光可能使部分人感到不适，请根据现场人员和环境谨慎选择效果和频率。

4. 线上房间和用户内容

你对自己创建的房间名称和发起的房间操作负责。不得发布或利用服务处理违法、欺诈、威胁、骚扰、仇恨、色情、侵害未成年人、侵犯隐私或知识产权、垃圾广告、冒充他人、恶意攻击、批量滥用接口、破坏设备或危害公共安全的内容和行为。

我们可依法采取限制展示、删除内容、关闭房间、限制功能、冻结或终止账号等措施，并可在法律要求时保存必要证据或配合主管机关。

App 会对公开房间名称进行自动过滤，并在公开房间卡片中提供“举报房间”和“屏蔽房主”入口。举报会进入管理员审核队列；屏蔽后，该房主创建的公开房间不再向你显示，你也无法通过房间码加入。不得恶意或批量提交虚假举报。

5. 使用许可和知识产权

在你遵守本条款的前提下，我们授予你有限、非独占、不可转让的个人使用许可。SupWand 的软件、界面、品牌、图形、文档及相关知识产权归我们或相应权利人所有。除法律明确允许外，不得复制、出售、攻击、绕过技术保护或侵犯相关权利。

你保留对自己依法享有的用户内容的权利，并授予我们仅为托管房间、同步灯光、执行安全治理和提供支持所必要的处理权限。

6. 服务调整、中断和终止

我们可能为安全、合规、兼容性、维护或功能改进而更新 App 或服务器。安全事件、不可抗力、网络故障或第三方服务异常可能导致暂时中断。我们会在合理范围内恢复服务并在法律要求时通知。

如你严重或重复违反本条款、危害其他用户或服务安全，我们可限制或终止相关服务。

7. 账号删除

你可以在 App 的“我的—关于 App—删除账号”中提交删除请求。二次确认后，删除不可撤销，全部会话会被撤销，账号个人信息和关联房间数据会按照《隐私政策》删除或匿名化。法律义务、争议处理或安全调查必须保留的信息除外。

8. 第三方服务

短信投递、云端托管、App Store 分发和系统权限可能由阿里云、Apple 或其他依法使用的服务提供方提供，并同时受其自身条款和隐私规则约束。

9. 责任边界

我们以合理的技术和管理措施提供服务，但不保证无线连接、第三方网络或所有非官方硬件始终可用。在适用法律允许的范围内，我们仅对因自身过错直接造成的实际损失承担责任。本条款不限制法律不得限制的消费者权利或法定责任。

10. 适用法律和争议解决

本条款适用中华人民共和国大陆地区法律。争议应先友好协商；协商不成的，可向运营主体住所地有管辖权的人民法院提起诉讼。法律另有强制规定的，从其规定。

11. 条款更新

如服务范围、用户权利或法律要求发生实质变化，我们会更新本条款和生效日期，并在法律要求时通过 App、支持中心或其他合理方式通知你。

SupWand Terms of Service

Operator: Shenzhen Sunjet Electronic Co., Ltd. By using the SupWand app, an account, online rooms, or lightstick controls, you agree to these terms and the SupWand Privacy Policy.

1. Scope and Eligibility

SupWand discovers, connects to, and controls compatible lightsticks and provides account, device-management, online-room, and lighting-synchronization features. You must have the legal capacity required for your use. Minors may use account and online features only after a parent or guardian has reviewed and agreed to these terms.

2. Accounts and Security

  • Accounts currently use a mainland China +86 phone number and SMS verification code.
  • Use only a phone number you are authorized to use and protect your phone, verification codes, and signed-in devices.
  • Do not sell, rent, impersonate, or bypass sign-in, permission, rate-limit, or other security controls.
  • Contact support promptly if you discover unauthorized account or device use.

3. Compatible Hardware, Permissions, and Connectivity

Bluetooth control requires compatible hardware, Bluetooth permission, and working firmware. Sound rhythm requires microphone permission. Online rooms require internet access and the production service. Distance, radio interference, battery level, firmware, permissions, networking, or maintenance may affect functionality.

Follow venue rules, applicable law, and on-site safety requirements. Flashing lights may cause discomfort for some people; choose effects and frequencies carefully.

4. Online Rooms and User Content

You are responsible for room names and actions you initiate. Do not use the service for illegal, fraudulent, threatening, harassing, hateful, sexual, child-exploitative, privacy- or intellectual-property-infringing content, spam, impersonation, malicious attacks, automated API abuse, device damage, or behavior that endangers public safety.

We may restrict visibility, remove content, close rooms, limit features, suspend, or terminate accounts as permitted by law, and preserve necessary evidence or cooperate with competent authorities where required.

The app automatically filters public room names and provides Report Room and Block Room Owner actions on public room cards. Reports enter an administrator review queue. After blocking an owner, rooms created by that owner are hidden and cannot be joined by room code. Do not submit malicious or bulk false reports.

5. License and Intellectual Property

While you comply with these terms, we grant a limited, non-exclusive, non-transferable personal license. SupWand software, interfaces, branding, graphics, documentation, and related intellectual property belong to us or the relevant rights holders. Except where law permits, do not copy, sell, attack, bypass technical protections, or infringe those rights.

You retain lawful rights in your user content and grant us only the permission necessary to host rooms, synchronize lighting, enforce safety rules, and provide support.

6. Changes, Interruptions, and Termination

We may update the app or service for security, compliance, compatibility, maintenance, or feature improvements. Security incidents, force majeure, networking, or third-party outages may cause temporary interruption. We will use reasonable efforts to restore service and provide legally required notice.

We may limit or terminate service for serious or repeated violations that endanger users or service security.

7. Account Deletion

You can request deletion from My — About App — Delete Account. After secondary confirmation, deletion cannot be undone. All sessions are revoked and account personal information and related room data are deleted or anonymized under the Privacy Policy, except information required for legal obligations, disputes, or security investigations.

8. Third-Party Services

SMS delivery, cloud hosting, App Store distribution, and system permissions may be provided by Alibaba Cloud, Apple, or other lawfully used providers and are also governed by their own terms and privacy practices.

9. Responsibility and Disclaimers

We use reasonable technical and organizational measures but do not guarantee wireless connections, third-party networks, or every unofficial device will always work. To the extent permitted by law, we are responsible only for direct, actual loss caused by our fault. These terms do not limit rights or liability that cannot legally be limited.

10. Governing Law and Disputes

These terms are governed by mainland China law. The parties should first attempt a good-faith resolution. If that fails, either party may submit the dispute to a court with jurisdiction at the operator's domicile unless mandatory law requires otherwise.

11. Updates to These Terms

If service scope, user rights, or legal requirements change materially, we will update these terms and their effective date and provide notice through the app, support center, or another reasonable method where required.
